Cancellation Policy

All sales are final. Upon any such cancellation, Supplier shall use its reasonable best efforts to resell the cancelled Super Bowl package elements to third parties for the full priced agreed to herein, or the best market value.

Failure to meet the above deposit schedule on the dates required will result in full cancellation with all deposits retained as partial damage settlement to Supplier.

Event Cancellation

Notwithstanding any other provisions of the Agreement to the contrary, if for any reason the Event is not played at the location or on the dates that it is scheduled to be played as of effective date of the Agreement, Client shall have the option, upon written notice to Supplier, to continue with this Agreement with the revised location and/or date constituting the Event.

Miscellaneous

Neither party shall assign this Agreement, or transfer its duties and obligations hereunder, to any third party. This Agreement embodies the entire understanding between the parties and shall take precedence over any conflicting terms and conditions set forth in any prior agreement, correspondence, quotation, proposal, or discussion relating to the subject matter hereof. Should any provision of the Agreement be held unenforceable or in conflict with the law of any jurisdiction, the validity of the remaining provisions shall not be affected by such holding. This Agreement can only be amended in a writing duly executed by authorized representatives of both parties. The laws of the State of Indiana, excluding conflicts of law provisions, shall govern this Agreement, which shall be binding upon the heirs, successors and/or legal representatives of the parties.
